These Terms of Use ("Terms") govern your use of the Fitoor mobile application ("Fitoor," "the app," "we," "us"). Fitoor is operated from Almere, the Netherlands. By downloading or using Fitoor, you agree to these Terms. If you don't agree, please don't use the app.

1. What Fitoor is

Fitoor helps you turn workouts you find or perform into structured, trackable training sessions, using AI to interpret text, images, PDFs, and links you provide, and to help you log workouts as you train.

Fitoor does not require an account. There is no sign-up, login, or subscription required to use the app at this time (see Section 8 on future paid features).

2. Not medical or professional fitness advice

Fitoor is a tracking and organizing tool, not a medical device, personal trainer, or source of medical advice. The app does not evaluate your health, fitness level, or physical capacity, and it does not generate or recommend workouts on its own — it structures workouts you already found or performed.

3. Your content

You own what you import. Text, images, PDFs, and links you submit to Fitoor remain yours. By using an import or AI feature, you grant us (and the third-party AI/processing providers listed in our Privacy Policy) the limited right to process that content for the sole purpose of extracting and structuring workout data for you, as described in our Privacy Policy.

You're responsible for what you submit. Don't import content you don't have the right to use (e.g. content clearly restricted from redistribution or copying), and don't attempt to use Fitoor's AI features to generate content unrelated to fitness tracking. Fitoor's parsing layer is designed to refuse requests that ask the AI to invent a workout from scratch rather than structure one you've provided — attempting to circumvent this is against these Terms.

4. Acceptable use

You agree not to: - Use Fitoor for any unlawful purpose - Attempt to reverse-engineer, decompile, or extract the app's source code beyond what's permitted by applicable law - Use automated means (bots, scripts) to abuse Fitoor's AI import or tracking features, including excessive or rapid submissions intended to strain the underlying AI providers - Misrepresent your identity or impersonate another person or entity while using the app - Attempt to circumvent any rate limits, input guardrails, or content restrictions built into the app

5. Third-party services

Fitoor relies on third-party providers (currently OpenAI, Google/YouTube, and Supadata) to power its AI and import features. These providers have their own terms and policies, and their availability, pricing, or behavior may change independently of Fitoor. We are not responsible for outages, errors, or changes on the part of these third-party providers, though we'll do our best to keep the app functional if they change.

Fitoor stores your workout templates, session history, and preferences locally on your device. This means:

Fitoor is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, accuracy of AI-interpreted content, or uninterrupted availability.

To the fullest extent permitted by applicable law, Fitoor and its developer are not liable for any indirect, incidental, or consequential damages arising from your use of the app, including but not limited to injury sustained while exercising, data loss, or reliance on AI-interpreted workout content. Nothing in these Terms limits liability that cannot be limited under Dutch or EU consumer protection law.

8. Future paid features

Fitoor is currently free to use in full. We may introduce optional paid features or a subscription tier in the future (for example, to offset the cost of AI processing at scale). If and when we do, we will update these Terms with specific pricing, billing, and cancellation terms before any payment is required, and your continued free use of the app will not be retroactively affected by features you didn't opt into.

9. Changes to these Terms

We may update these Terms as the app evolves — for example, when new features are added or if a paid tier is introduced. We'll update the "Last updated" date above when we do. Continued use of the app after a change constitutes acceptance of the updated Terms.

10. Termination

You may stop using Fitoor at any time by deleting the app. We may discontinue or modify the app or any feature at our discretion, though we'll aim to give reasonable notice for anything that materially affects your access to your own data.

11. Governing law

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles, without prejudice to any mandatory consumer protection rights you have under the law of your country of residence if you are an EU consumer.
